Former Real Housewives of Atlanta star Kandi Burruss is now facing a custody battle amid her split with husband Todd Tucker.
According to US Weekly, Tucker is seeking primary physical custody of the now-estranged couple's two children, Ace, 9, and Blaze, 6, as their divorce moves forward.
Tucker argued in a counterclaim filed last week that the children primarily live with him in Georgia while Burruss travels for “out-of-state work obligations.” According to the filing, Burruss’ upcoming professional commitments will require her “to be away from the children for at least the next several months,” which prompted Tucker's request for primary custody, joint legal custody, and final decision-making authority if the pair cannot reach an agreement.
The move comes after Burruss announced last month that she and Tucker were divorcing after 11 years of marriage. Burruss revealed that the two had been separated since July 2025, and their marriage was "irretrievably broken."
“After deep thought and a lot of prayer, I’ve made the decision to move forward with a divorce,” the Grammy-winning songwriter previously told People. “My focus remains on protecting my peace, being the best mother I can be, and co-parenting with love and respect.”
As the divorce moves forward, Tucker is also seeking a full division of marital assets, stating that while he and Burruss have been “working cooperatively” to resolve issues, a complete settlement has not yet been reached. Tucker raised questions about the enforceability of the prenuptial agreement he signed before their April 2014 wedding, claiming he was pressured to sign immediately before the ceremony without his legal team present. His lawyers argue Burruss’ counsel presented the finalized prenup without notice, despite prior communications with Tucker’s representatives.
If the prenup is ruled invalid, Tucker is seeking potential alimony in addition to custody and property division.
